| The board of managers has a variety of rights and remedies available
to it, at common law, under the Condominium
Property Act, and according to the association's governing documents,
against unit owners, tenants, invitees, and guests who default or
violate the covenants or rules.
The remedies include an eviction action in forcible entry
and detainer against the unit owner or a tenant. The board
has a statutory right to recover attorneys' fees incurred due
to a default, and the amount thereof is to be added to the
unit owner's share of common expenses.
Enforcement actions can be complex and difficult lawsuits.
The board must retain a competent attorney to prosecute enforcement
matters. |
