A. Assessment
collection
Collection of delinquent assessments including handling of forcible
entry and detainer cases (evictions), mortgage foreclosures,
association lien foreclosures, creditor bankruptcy cases, and
other types of lawsuits involving collection of money.
B. Advice
regarding operations
Legal advice and opinions on numerous areas of association
law, management and operational issues including, election
and removal of board members, development of budgets and
establishing reserves, insurance issues, the
fiduciary duties of the board of directors, repair and management
of condominium common elements, audits and accounting issues,
passage of special assessments, member relations and dealing
with difficult association members, requests for books and records,
and members' legal challenges to the board.
C. Agreements
Preparation and negotiation of agreements and other legal documents
including construction, service, management, cable television,
security, employment, and various other kinds of agreements and
transactions.
D. Declarations,
bylaws and rules
Interpretation and drafting of association governing documents,
including amendments to declaration and bylaws, preparation of
rules and regulations, and corporate documents.
E. Enforcement
and fines
Legal actions to enforce
associations' governing documents and rules including enforcement
of fines and court action against violators.
F. Housing
Discrimination
Advice and representation in connection with the Fair Housing
Act, the Americans with Disabilities Act, the Human Rights Act,
and other civil rights matters and issues.
G. Liability
and Insurance
Monitoring of insurance defense of personal and bodily injury
claims brought against associations, and representation with
respect to liability issues generally and for recreational facilities
operated by associations.
